Standing commitee meeting
TEPU REPORTS
The Standing Committee of National Council met at New Delhi on 25.5.2010. General Secretary TEPU Sri.V.Subburaman participated.
Decisions arrived in the meeting is briefed below:
Compassionate Ground Appointment
Management informed that compassionate appointment for cases related up to the year 2008 has been processed and disposed by the High Power Committee. In all 400 cases considered and approval accorded by the committee for which orders will be sent within 10 days. Other claims of 2009 and subsequent period is under process.
ACP in Telecom Accounts
After brief discussion it was agreed to resolve conflicts by a sitting of small group with SEA and to further discuss in the next Standing Committee meeting and reach settlement.
Pay Scale up gradation of Senior TOA / TM etc
The issue pending in the Promotion Committee was further discussed. It was decided to informally discuss with GM (Est.) and to have formal discussion in the next meeting of the Standing Committee.
Pay Anomaly
The file forwarded to Executive Director (Finance) had bounced back seeking some more clarifications. The establishment section is processing and will resubmit the file to ED (F)
Designation Change of Non Executives
The committee formed for the purpose will deliberate and decide the issue shortly
TSM Regularisation
Based on the judgements, the possibilities for regularisation will be explored and decided within a fortnight.
Approval of 9200, 9850 Pay Scale
The issue is under process with DOT. All efforts to get the pay scales implemented under NEPP will be expedited and corresponding New Scales after approval will be announced

Did Telecom biggies form cartel for 3G bidding? | ||||||||
Conspiracy theories are associated with all big historic developments. No wonder, India’s most successful spectrum auction has its own share of conspiracy theories. There were rumours towards the last few days of the 3G spectrum auction that some kind of understanding (or cartelisation) has reached among a group of bidders so that the spectrum prices do not go up further. We do not believe this, but there is an interesting trend on the footprint of 3G spectrum these operators have got. It is here for the readers to make their own conclusions. An analysis of the six biggies of the circles won by 6 biggies namely Airtel, Vodafone, Idea, TTSL, Reliance Communications and Aircel shows some interesting trend. The circles won by Tata Teleservices and Aircel are almost altogether different and if combined lead to a pan-India presence. Recent Income-Tax reports which were leaked out, speculated ownership links between TTSL and Aircel. Another visible trend which may spark off cartelization allegations, is an analysis of the circles won by Bharti Airtel and Vodafone. This again points out hardly any circles which overlap between the two firms. Indian telecom industry has been charged with cartelization allegations in the past as well when incumbents were accused of resorting to such tactics while formulating tariff plans. |

Additional sanction for welfare fund
An additional amount of Rupees 60.50 lakhs has been sanctioned to various circle welfare boards. Tamilnadu will receive Rupees 20 Lakhs and Chennai Telephone will get Rupees 10 Lakhs. STR Chennai is allotted Rupees 3 Lakhs.

India’s Auction for Broadband Wireless Access (BWA) started today with 11 telecom players, just days after the auctioning of 3G airwave for third-generation mobile services in the country.
Leading telecom players Bharti Airtel, Reliance Wimax Ltd, Idea Cellular, Aircel, Augere Mauritius, Qualcomm, Infotel Broadband Services, Spice Internet Service Provider, Tata Communications, Tikona Digital Networks and Vodafone Essar are expected to participate in the BWA auction to acquire the two slots on offer.
The reserve or base price is Rs.1750 crore for a pan-India BWA spectrum licence.Two blocks of 20MHz unpaired spectrum in the 2.3GHz band in each of the 22 telecom circles in the country will be up for bidding.
State operators BSNL and MTNL, which have already been been given spectrum, ahead of the private players, will have to pay the equivalent of the winning bid in each service area."

Bonus Points: Centre to dole out payouts to performing employees
The Indian government is finally going the corporate way. The stage has been set for introducing performance-linked payouts which may force over five million central government employees to deliver their best.
What may make even corporate executives envious of the new bonanza for central government employees, particularly of the brass, is the proposal of a 20% hike for the best performers over and above the raise that they had received after the sixth Pay Commission’s recommendations two years ago.
Yet for the babus, it won’t be a cakewalk either, as the formula of assessing the government employees as proposed by performance management division under the cabinet secretariat, has ruled out paying even a penny to an official if his ministry scores 70 or below in a scale of 100.
But a secretary of a high performing ministry which meets 100% target will be eligible to receive Rs 2.4 lakh extra per year if the cabinet secretariat’s proposal of a 20% performance-linked payout is endorsed by the government, according to an official in cabinet secretariat.
The first round of assessment, initially for three months from January to March 2010, is over and three out of 59 central government departments have got a 100% score. There is a strong possibility that a large number of government employees would receive an extra pay once the new formula is adopted.
“We are extending the performance monitoring and evaluation system to 62 departments from the current fiscal. According to our system, a department sets a target, fixes the weightages of each target, and if it succeeds meeting all its targets, it gets a score of 100. Now, we are proposing that if a department meets all its targets, the head of the department would be given a performance bonus of 20% or more of his basic salary. And other employees too will get such bonuses,” said an official in performance management division.
He further says how the government has failed to implement performance-linked incentives for its employees for the last 20 years though such recommendations were mooted by successive pay commissions including the more recent Sixth Pay Commission.
Several countries such as Canada, New Zealand, Australia, Netherlands, Denmark, UK, US and Finland have moved away from the traditional government administrative model to a management model under which officers act like corporate managers as they get greater operational freedom, but are held accountable for results. In fact, New Zealand is considered to be the leader of the pack where performance of government agencies are weighed in by setting targets and adopting regular evaluations.
Though there were several attempts in India too to bring in performance management in an institutionalised way, the process got kickstarted only after World Bank’s senior economist Prajapati Trivedi was appointed as secretary to the government of India with the responsibility for performance management early last year. Dr Trivedi, along with cabinet secretary KM Chandrasekhar, introduced a tool called Results Framework Document (RFD) which will set targets for each ministry and will finally be the basis for yearly evaluation.
Dr SP Parashar, a former director of IIM Indore, says that the government had in the past too dealt with the subject by introducing themes such as Programming, Planning, Budgeting (PPB), Zero Base Budgeting (ZBB), and Outcome Budgeting (OB), to name a few. “You might be wondering what happened to them? They went with their champions. Lets hope that Results Framework Document (RFD) stays. The real challenge and test of any change program in our kind of democracies is its continuity...” he says.
He agrees that at concept level, Results Framework Document captures international best practices in respect of government performance management, but it misses the heart of good performance being implemented in the corporate world. “It is fixing individual responsibility in addition to departmental responsibility. The Results Framework Document as currently devised and adopted uses departmental responsibility and score as proxy for individual responsibility and score,” he says.
Yet, with 62 government ministries and departments on board with a few exceptions like PMO, home and defence, the performance of central ministries is under close watch. Though SundayET has learnt that only three ministries met 100% targets and some could not even meet 50%, it remains to be seen when and how the government makes those report cards public.

USO Fund Pakistan leads the way

While India and Brazil with over $4 billion and $5 billion, respectively, collected under the US Funds (Universal Services), grapple with how to use them to improve telecom services in rural areas, Pakistan with a much smaller fund seems to have made good progress.
Pakistan has been able to spread and roll out services from its roughly around annual $200 million fund under its focussed rural telecom and eServices programme, said Mr Parvez Ifthikar, Chief Executive Officer (CEO) of Universal Service Fund (USF), based in Islamabad.
The USF has targeted 12,000 un-served Mauzas (of the total 60,000) in the country this year. A Mauza is the smallest, administered unit in Pakistan. Having divided under 26 lots for promoting rural telecom, the bidding process has been completed for 10 lots and sold, he told an Expert Forum Meeting on Mobile 2.0, organised by LIRNEasia, a Sri Lanka-based telecom think-tank recently.
Interestingly, while in India, a telecom operator has to contribute 5 per cent of its annual revenue to the USO Funds, Pakistan charges much less at 1.5 per cent. In India, the funds go to the national budget and the Department of Telecommunications has to make projects to source them, in Pakistan a separate company has been created to utilise the funds.
Renewable energy mandatory
In a bold move, the Pakistan Telecom Authority, the telecom Regulator has made it mandatory that all bases stations being set up with support from the USF should be ‘Green Sites' or renewable energy powered, especially solar and wind as the case may be. The reason being that there is currently, a huge shortage of electricity in rural Pakistan.
In India, renewable energy players, especially the solar energy industry has been making a strong plea that solar power should be encouraged to power the telecom towers in rural areas and the USO (universal services obligation) Funds could be utilised for it.
The USF has also taken up a project to lay OFC cable network in 31 Tehsils. About 8,000 km of cable route was needed, Mr Parvez told Business Line.
USF structure
One of the reasons for the early take off of the utilisation of USF in Pakistan could be attributed to the creation of a separate entity registered as a company with 50 per cent private sector participation on the 10-member board. It has a Chief Executive Officer, in Mr Parvez Ifthikar, who was earlier country head of Siemens Telecom.
And this is the story of DOT dealing the funds
NEW DELHI: The government auditor CAG has pulled up the department of telecommunications (DoT) for not utilising funds of over Rs 18,000 crore collected for promoting rural telephony and giving false picture about the unused sums.
"A total universal levy of Rs 26,163.96 crore was collected during 2002-03 to 2008-09 by the DoT, but a disbursement of only Rs 7,971.44 crore was made from the fund during the period," the Comptroller and Auditor General (CAG) said in its report on the Union government's performance.
The closing balance of the USO fund as on March 31, 2009, the report said, should be Rs 18,192.52 crore and not 'nil' as shown in the DoT accounts.
The corpus of the universal service obligation (USO) fund, which was set up by the government in 2002 to promote rural telephony, is collected through a levy of 5 percent of adjusted gross revenue from telecom operators.
The fund is administered by the DoT. The levy received towards USO fund is first credited to the Consolidated Fund of India and subsequently the Centre credits such proceeds to the USO fund in the Public Account of India from time to time, for being utilised exclusively for meeting the USO.
The fund was created with the objective of utilising the proceeds exclusively for meeting the universal service obligation by providing access to telegraph services to people in the rural and remote areas at affordable prices.
The CAG recommended that the DoT formulate schemes for utilising the USO fund in the same year it is collected. "DoT may also ensure that viable schemes for implementation of USO for rural and remote areas are executed in timely fashion so that USO objectives are met and fund balances are utilised for the purpose it is created," the CAG said, regretting that currently the unspent balances are used for bridging budget deficit.

Having divided under 26 lots for promoting rural telecom, the bidding process has been completed for 10 lots and sold, he told an Expert Forum Meeting on Mobile 2.0, organised by LIRNEasia, a Sri Lanka-based telecom think-tank recently.
Interestingly, while in India, a telecom operator has to contribute 5 per cent of its annual revenue to the USO Funds, Pakistan charges much less at 1.5 per cent. In India, the funds go to the national budget and the Department of Telecommunications has to make projects to source them, in Pakistan a separate company has been created to utilise the funds.
Renewable energy mandatory
In a bold move, the Pakistan Telecom Authority, the telecom Regulator has made it mandatory that all bases stations being set up with support from the USF should be ‘Green Sites' or renewable energy powered, especially solar and wind as the case may be. The reason being that there is currently, a huge shortage of electricity in rural Pakistan.
In India, renewable energy players, especially the solar energy industry has been making a strong plea that solar power should be encouraged to power the telecom towers in rural areas and the USO (universal services obligation) Funds could be utilised for it.
The USF has also taken up a project to lay OFC cable network in 31 Tehsils. About 8,000 km of cable route was needed, Mr Parvez told Business Line.

One of the reasons for the early take off of the utilisation of USF in Pakistan could be attributed to the creation of a separate entity registered as a company with 50 per cent private sector participation on the 10-member board. It has a Chief Executive Officer, in Mr Parvez Ifthikar, who was earlier country head of Siemens Telecom.

NEW DELHI: The government auditor CAG has pulled up the department of telecommunications (DoT) for not utilising funds of over Rs 18,000 crore collected for promoting rural telephony and giving false picture about the unused sums.
"A total universal levy of Rs 26,163.96 crore was collected during 2002-03 to 2008-09 by the DoT, but a disbursement of only Rs 7,971.44 crore was made from the fund during the period," the Comptroller and Auditor General (CAG) said in its report on the Union government's performance.
The closing balance of the USO fund as on March 31, 2009, the report said, should be Rs 18,192.52 crore and not 'nil' as shown in the DoT accounts.
The corpus of the universal service obligation (USO) fund, which was set up by the government in 2002 to promote rural telephony, is collected through a levy of 5 percent of adjusted gross revenue from telecom operators.
The fund is administered by the DoT. The levy received towards USO fund is first credited to the Consolidated Fund of India and subsequently the Centre credits such proceeds to the USO fund in the Public Account of India from time to time, for being utilised exclusively for meeting the USO.
The fund was created with the objective of utilising the proceeds exclusively for meeting the universal service obligation by providing access to telegraph services to people in the rural and remote areas at affordable prices.
The CAG recommended that the DoT formulate schemes for utilising the USO fund in the same year it is collected. "DoT may also ensure that viable schemes for implementation of USO for rural and remote areas are executed in timely fashion so that USO objectives are met and fund balances are utilised for the purpose it is created," the CAG said, regretting that currently the unspent balances are used for bridging budget deficit.

Sub:- Revision/ consolidation of Pension in IDA scale for the erstwhile DOT Employees retiring as BSNL Pensioners during the period from 01/10/2000 to 31/12/2006
Respected Sir,
1. We are glad to know and note that as per promise given to JAC on 20.04.2010, you have taken personal interest and paying special attention caused clearance of 2nd Wage Revision for BSNL Non-Executive Employees. We convey our sincere thanks to you for your noble act.
2. We remember that in the said meeting, JAC was promised that an issue of revising pension of pre 01.01.2007 BSNL Pensioners will be taken care and cleared within three months.
3. We enclose herewith a copy of our letter No: BDPA/Guj/Pen dated 15.03.2010 addressed to Shri P.J. Thomas, Secretary DoT, on the captioned subject.
4. We were happy to have your assurance and had sigh of satisfaction that at last our genuine grievance has been reached before you and being convinced of injustice to the BSNL Pensioners, you were kind enough to assure the positive settlement within three months.
5. We are agonized and deeply hurt to have inkling that notwithstanding your solemn assurance and positive approach, the Cabinet Note is reportedly prepared on wrong footing as it proposes approval for 30% weightage on basic pension alone to the BSNL Pensioners retiring before 01/01/2007. This proposal violates the principles of natural justice and it is highly discriminatory and unjust because the serving employees in BSNL were accorded 50% IDA Merger with effect from 1.1.2007, which was denied to BSNL Pensioners on the plea that this problem shall be sorted out along with Pension Revision. Further the Serving employees in BSNL were accorded 30% weightage on Basic Pay plus Industrial DA as on 1.1.2007 to work out their revised pay package. Pension Revision of BSNL Pensioners should follow the same pattern and be consistent with DPE guidelines on Pay Revision based on which IDA scales in BSNL have been revised.
6. We firmly desire and hope that in order to administer justice to pensioners, your honour will ensure that Pension Revision in BSNL is carried out in a manner similar to that of working employees in BSNL with identical weightage given to pensioners as given to the serving Employees as per the practice followed by the two Ministries i.e. Ministry of Transport and Ministry of Food in respect of IDA Pensioners under their control i.e. Port and Dock Pensioners and Pensioners retiring from Food Corporation of India.
7. We wish and propose for BSNL Pensioners Pension Revision on IDA pattern and submit before you to kindly take note of following issues while framing Cabinet Note.
(a) Current Status of IDA Pension Revision for CPSUs/ CABs under the control of Ministries of Communication, Ministry of Food and Ministry of transport.
(b) Fifty percent IDA Merger for all BSNL Employees w.e.f. 01/01/2007 was implemented by DOT and BSNL in May 2008 vide order dated 29/5/2008 issued by BSNL. Revision of IDA scales for BSNL Executives was carried out by BSNL in May 2009 after due approval by Ministry of Communications. Agreement for revision of IDA scales for non-Executives has recently been approved by BSNL under similar pattern/ fixation formula as given to Executives in May 2009 and the same is awaiting concurrence of DOT for implementation.
(c) The Department of Telecom last year in 2009, shelved the proposal of 50% IDA Merger for BSNL Pensioners retiring before 01.01.2007 on the plea that DOP and DPE did not accord approval to 50% IDA Merger for BSNL Pensioners and further decided that the issue of 50% IDA Merger shall get resolved automatically along with Pension Revision in IDA scale in the near future.
(d) DOT is reportedly further unable to carry out Pension Revision in IDA Scale for all the Ex-DOT Employees absorbed in BSNL and retired as BSNL Pensioners between 01.10.2000 to 31.12.2006 because no Rules/ Instructions are available/ or have been framed so far for revision of Pension under IDA Scale. In fact, this is the first case of revision of pension after formation of BSNL w.e.f. 01.10.2000. Under these circumstances either DOT has to follow the precedent set by Ministries of Transport and Ministries of Food for IDA Merger/ IDA Pension Revision in CPSUs/ CABs under their control or else Rules/ Instructions need to be framed afresh for BSNL Pensioners and be approved by Union Cabinet through a Cabinet Memo to enable the Pension Revision in IDA Scale.
(e) The authorities in DOT were apprised of the fact that approval for 50% IDA Merger for Pensioners retiring before 01.01.007 has already been granted by Ministry of Transport for the Pensioners of Port Trust and Dock Workers w.e.f. 1.1.2007 vide Memo no.A-29018/4/2008-P.E.I dated 5/11/2008. It has also been pointed out to DOT that simultaneous Pension Revision with five year Wage Agreement under identical fixation formula has been approved by Ministry of Transport for Port and Dock Workers vide memo no.IPA/BWNC/2009 dated 27.01.2010. But these approvals by Ministry of Transport for 50% IDA Merger and IDA Pension Revision have so far not evoked any positive response from DOT to emulate the same in case of BSNL.
(f) For your perusal and kind knowledge we would like to state that Ministry of Food has revised the Pension of the Employees of Food Corporation of India on IDA scale three times in the year 1987. 1992 and 1997 under the same formula as provided for working Employees. Pension Revision ordered by Ministry of food for IDA Pensioners’ in Food Corporation of India w.e.f. 1.1.1997 was subject to Supreme Court judgment in CA Civil No.238-244 of 2004. Judgment in CA Civil No.238-244 of 2004 was delivered by Hon’ble Supreme Court on 10/2/2010 but it does not nullify or alter the IDA Pension Revision carried out by Ministry of Food for FCI Pensioners w.e.f. 1.1.1997.
(g) To prove and strengthen our say we would like to write that Orders for Fourth revision of pay on IDA scales for Executives in FCI with effect from 01/01/2007 have been issued vide Memo.No.WRC/1/1//007/ Vol.III dated 18.9.2009 based on the formula given by DPE i.e. Old Basic Pay on IDA scale on 1/1/2007 * 178.2 plus 30% weightage on the same. Agreement for Fourth revision of pay on IDA scales for Non-Executives in FCI with effect from 01/01/2007 has been signed and approved by Ministry of Food vide Circular no.WR-09-2010-06 vide Memo No.WRC/1/2/2009 dated 09/04/2010 based on the formula given by DPE i.e. Old Basic Pay on IDA scale on 1/1/2007 * 178.2 plus 30% weightage on the same.
We are informed by the FCI Pensioners Association that Pension Revision on IDA scale w.e.f. 1/1/2007 for past FCI Pensioners as per the formula given by DPE for working employees is already under process and shall be carried out by the Ministry of Food within a period of one month or so.
(h) DOT’s earlier Proposal for granting CDA Pension based on DOP Memo No.4/14/2001-P&PW (D) dated 19/09/2003 was abandoned by DOT because of strong opposition of DOP, change in stand of ITSA towards CDA Pension and opposition from BSNL Unions / Associations who realized the loss to be incurred by the Employees in case of CDA Pension.
NOW IN LIGHT OF WHAT WE EXLAINED ABOVE, WE SUGGEST AND DEMAND PENSION REVISION ON IDA AS UNDER:
That the DOT’s Current Proposal for granting IDA Pension revision w.e.f. 01.01.2007 based on hypothetical and arbitrary interpretation of sixth pay commission recommendations may be done away with immediately.
We propose that the formula which is applied for working Executive/Non Executive Employees for their Pension should be made equally applicable to all pre 01.01.2007 Pensioners without any discrimination.
And accordingly, as we propose that the revised proposal for IDA Pension revision, to be incorporated in the Cabinet Memo should be as follows:
Revised IDA Pension on 1/1/2007 = Existing IDA Basic Pension + 78.2% IDA on Existing Basic Pension + 30% weightage on Existing Basic Pension
Thus Revised IDA Pension as per latest reported proposal to be moved through Cabinet Memo = Existing IDA Basic Pension on 1/1/2007 * 1.988
All BSNL Employees retiring after 1/1/2007 were given 50% IDA Merger and 18.8% IDA on their (Basic Pension + Dearness Pension). Their revised Pension w.e.f. 1/1/2007 amounted to Existing IDA Basic Pension + 78.2% IDA on Basic Pension + 30% of (Existing IDA Basic Pension + 78.2% IDA on Existing Basic Pension.)
Thus for BSNL retirees after 1/1/2007 their revised Pension as per existing BSNL formula = Existing Basic IDA Pension * 1.68 *1.3 = Existing Basic IDA Pension * 2.184
As per formula given by DPE, the BSNL retirees after 1/1/2007 their revised Pension should be = Existing Basic IDA Pension * 1.78 *1.3 = Existing Basic IDA Pension * 2.314
In view of above submissions, we request you to kindly look into the matter and adopt the fitment formula given by DPE for revision of IDA pay of CPSU Employees and make it applicable for revision of IDA Pension for BSNL Pensioners retiring between 1/10/2000 to 31/12/2006 as has been done in the case of serving BSNL employees as detailed below:-
Revised Pension as per existing approved BSNL fitment formula = Existing Basic IDA Pension * 1.68 *1.3 = Existing Basic IDA Pension * 2.184
Though as per formula given by DPE, the BSNL retirees revised Pension should be = Existing Basic IDA Pension * 1.78 *1.3 = Existing Basic IDA Pension * 2.314
The issue of 50% IDA Merger w.e.f. 1/1/2007 also needs to be resolved along with IDA Pension Revision as promised earlier by the Ministry of Communications.

Consequent to introduction of CDR billing system, BSNL has decided to send SMS alerts to its and line and Broad band subscribers. To start with, subscribers in 19 Telecom districts named Bhubneshwar (Orissa), Bhopal (MP), Balasore, Dehradun (Uttranchal), Hyderabad, Hassan, Kodagu, Jammu, Kamrup (Assam), Kalyan (Maharashtra), Lucknow, Meeruth (UP) Jaipur (Rajasthan), Raipur (CG),Tejpur (Assam), Tuticorin, Tirunelvelli and Vellore (Tamilnadu) will be offered these services. For telephone bills as and when they are generated, birth days, last date for bill payment reminders, 80% of broad band usage are some of the items on which SMS will be sent. Our comments:-- So we can expect the file with BSNL within a couple of days and as agreed on strike negotiations, BSNL Board will immediately act on it and orders may be released soon, perhaps before the end of next week. But, even after the instructions of the Hon'ble Minister, no discussions to merge 78.2% of IDA was initiated by the recognised union is regrettable.
