Is BSNL over staffed?

The country's leading news paper "The Hindu" has raised its voice in favour of the Government employees. In its report dated 30-1-2012, it has categorically denied the Government's "theory" that the Government organisations are over staffed.

Size of the Govt. Employees: Myth and the Truth:


A big hue and cry has always been made about the size of the govt. employees in India. To reduce the number of govt. employees, the govt. of India introduced the ‘‘Ban on Recruitment’’, way back in 1984 itself. Ever since the introduction of the Neo- Liberal Economic policies, the govt. of India has taken various steps, for the downsizing of the strength of the govt. employees.

However, various surveys have now revealed the truth. Accordingly, the number of govt. employees that India is having, in comparison to the population, is only one fifth of the employees that the US govt. is having. India is having 1622.8 govt. servants (both central as well as states) for every 1, 00,000 people. Whereas, the US is having 7681 employees per 1, 00,000 people. The number of Central govt. employees in India is 31 lakh. This comes to 257 employees per 1, 00,000 people. But the US Federal govt. is having 840 employees per 1, 00,000 people. For everything the Indian govt. is following what the US is doing. On the employment of govt. employees, why can’t India follow the US?

The Central Board of Direct Taxes has notified the scheme exempting salaried taxpayers with total income up to Rs.5 lakh from filing income tax return for assessment year 2011-12, which will be due on July 31, 2011
.  Individuals having total income up to Rs.5,00,000 for FY 2010-11, after allowable deductions, consisting of salary from a single employer and interest income from deposits in a saving bank account up to Rs.10,000 are not required to file their income tax return. Such individuals must report their Permanent Account Number (PAN) and the entire income from
bank interest to their employer, pay the entire tax by way of deduction of tax at source, and obtain a certificate of tax deduction in Form No.16. 
Persons receiving salary from more than one employer, having income from sources other than salary and interest income from a savings bank account, or having refund claims shall not be covered under the scheme.
The scheme shall also not be applicable in cases wherein notices are issued for filing the income tax return under section 142(1) or section 148 or section 153A or section 153C of the Income Tax Act 1961.

BSNL Has right to change recruitment rules --- Supreme court declares

Govt has total power to change recruitment rules, says SC

New Delhi: The Supreme Court has ruled that the government has absolute constitutional power to amend recruitment rules with retrospective effect, including age of superannuation, irrespective of any undertaking given to employees.

A bench of Justices Markandeya Katju and Gyan Sudha Mishra in a judgement said even if the government had given any undertaking to the employees, the same was not binding as recruitment rules’ powers emanating from Article 309 of the Constitution were absolute.

“A rule made under the proviso to Article 309 is a legislative act. It is not a piece of delegated legislation like a rule made under a statute. Hence it can be amended retrospectively.

“When rules are framed under Article 309 of the Constitution, no undertaking need be given to anybody and the rules can be changed at any time. For instance, if the retirement age is fixed by rules framed under Article 309, that can be changed subsequently by an amendment even in respect of employees appointed before the amendment,” Justice Katju observed.

The apex court passed the ruling while setting aside an Allahabad High Court judgement which held that public sector firm BSNL cannot change the rules of recruitment if the organisation had given any prior undertaking to the employees.

In this case, the BSNL in 2005 had brought in certain amendment to the recruitment rules vis-à-vis appointment of Hindi language officers that all posts should be filled up by ‘Limited Competitive Examinations.’ The amended rules according to the aggrieved employees were contrary to the written assurance given by the government an year before that the rules would not be changed for the next three years.

The BSNL defended the move saying it was required to fill up the posts through competent and suitable candidates. However, the high court struck down the amended rule saying the government cannot retract on its own undertaking given to the employees. Aggrieved BSNL appealed in the apex court.

Upholding the appeal, the apex court said a conscious decision was taken in 2005 providing that all the posts in question should be filled up by the Limited Internal Competitive Examination. “This was a policy decision and we cannot see how the High Court could have found fault with it. It is well settled that the court cannot ordinarily interfere with policy decisions.

“Hence, we cannot accept the view taken by the high court. There is no question of equity in this case because it is well settled that law prevails over equity if there is a conflict. Equity can only supplement the law, and not supplant it. As the Latin maxim states ‘Dura lex sed lex’ which means The law is hard, but it is the law,” the apex court said. PTI

A December 2010 report by the Telecom Regulatory Authority of India (TRAI) says that of the 40 million copper loops (that cover the last mile) countrywide, only half are considered usable for broadband Internet connections. This most widely used medium, twister copper wires owned mostly by BSNL or MTNL, are largely old and inadequate for carrying data. Since very few telcos are putting any fresh copper in the ground, the number of usable copper loops for broadband in the country is expected to run out by 2014.

Violate license conditions and get huge rebates on fine!

The Government has decided to protect the private telcos at any cost. Now they have decided to offer a rebate of 99% on the fines levied to those who violated license conditions.

A note from the department of telecommunications (DoT) for a meeting of the full Telecom Commission (TC) has recommended only Rs 28.85 crore be charged as penalty , which is less than 1% of the cumulative penalties of Rs 3,000 crore applicable under the licence agreement . Telecom secretary R Chandrashekhar said the date for the Telecom Commission’s meeting was yet to be finalized.

Can BSNL survive?

well BSNL service technically is good and better than anyone else. but the Customer support is horrible, they don't know anything i.e. which includes, reading,speaking, technology. the other problem is bribe in office for contracts and also with competators.
an example, BSNL 3G was excellent i.e. 2mbs speed before Airtel Launced there 3G in Bangalore. Once Airtel annonced 3G, BSNL 3G started showing problem why is it so? what happend all of a sudden? how money did BSNL ppl took to downgrade this service. this is problem? fix it ppl will go bsnl.

A. The core reason for the poor state is the Management and No check from Government. The BSNL is managed by ITS. They are not leaving the BSNL and not absorbing in BSNL. The TOP managers managing in CIRCLES are on verge on retirement and thus having no creativity and interest in work. They are only working on NUMBER GAME. No one is interested in Revenues. The ITS culture is that sub ordinates (ITS) always say "YES SIR" wheather it is RIGHT or WRONG. More over most of the schemes and Plans are created in "A.C. ROOMs' far away from customers and no suggestion are taken from field units. Most of the managers believe in "WE DONT WANT INTELLIGENT OFFICERS and WORKERS but WE WANT OBEYING AND CHAMMACH STAFF".
Therefor it is very essensial to replace the TOP manager and prefarebly from MARKET PROFESSIONALS

: i think BSNL should be privatised for some years, say 5 years. Employees should not be retrenched. The private player so choosen should make good use of BSNL staff strength, should continue to hold organise training programmes etc for better & efficient implementation of manpower.The private player should be allowed to take the best possible talent from the industry on deputation/ purely contract basis as BSNL is also facing staff shoratge.After the required period say 5 years, definitely the private player would have made huge profits.

Do Not Believe Rumours

Some rumours are on the round, perhaps by some vested interests, that from 2/2011, only Pay plus DA will be paid and all allownces will be cut, as BSNL is in a very tight financial crisis. CS/ Tamilnadu Circle, Sri D.Chandrasekar clarified and informs that there is no basis for this rumour and employees need not be afraid of. 
   Of course, the company is in red. To tide over, it has obtained a loan of Rs. 2500 crores. For the next financial year, it is applying for another 14,500 crores loan. So, employees will not be losing any allowance.
   To cut the allowances may, perhaps, be suggested by some Executives, because of whom only the once mighty BSNL is facing such a crisis. The unions (both Executives and Non-executives) are also not making any sincere attempt to cut the avoidable unnecessary expenditures. Efforts in this direction only will save the BSNL. but read here what one Executive has suggested.

Can we agree with any of the above suggestion? How the officer thinks that by curtailing temp. advance will be a savings is known to him only. See that suggestion to cut the salary by Rs.1000/=. Perhaps this may be another reason for the rumour. But may be, the administration may consider this suggestion alone as this has been suggested by an Executive , for whom, of whom and by whom the BSNL runs. And BSNL knows pretty well the recognised non-executive union  will simply announce a day's dharna after such anti-labour actions are implemented. It also knows pretty well that all other unions will blame each other and will not unite and rise to save BSNL.

MNP brings in fresh problems

The much-sought after program of TRAI , the MNP, has brought in fresh problems which  may be a threat to national security. Economic times reports as below:--

Reports of calls from SIMs after MNP stir concern

KOLKATA: The telecom department has detected numerous instances across the country where people are making calls on their officially deactivated SIMs even after availing of mobile number portability (MNP), raising concerns of abuse and possible security risks . The department’s vigilance wing has found that possible software glitches at the operator’s end have enabled customers on both prepaid and postpaid platforms to make outgoing calls from their old SIMs.

It has also asked all telecom firms to ensure that mobile phone SIMs are deactivated as soon as a customer ports out. A director in the telecom department’s legal wing confirmed this and said it was “illegal and a breach of licence conditions” . Under present licence conditions , once somebody ports out, there is a twohour window for deactivating the old SIM and re-activating the new one on the network he migrates to.


“But if the old SIM remains active, it opens up possibilities for serious abuse at the user end and monitoring challenges since a single number would be active on two mobile networks,” the official quoted above added. “The potential challenges of tracing calls made from the old SIM after a number migrates to a new mobile network were discussed at a recent meeting in the telecom department. Operators have promised to fix all software glitches that may have triggered such aberrations,” said a senior executive mobile phone company who attended the meet.

“If a person, whose mobile number is being tapped, happens to port out to a new network and discovers that his old SIM works, he can make calls using the old SIM and skirt surveillance. Under the present phone tapping system , once porting happens, a mobile number under surveillance will be under observation only on the new network,” said A Ghosh, director general in DoT’s vigilance wing.

Directly compensate the telecom consumers harassed by unsolicited telemarketing SMS or calls


BJP’s newly constituted Telecom Consumer Cell took up the issue of unsolicited commercial communication (SMS and voice calls) with the chairman of Telecom Regulatory Authority of India (TRAI) on January 27. In a memorandum presented to TRAI chairman Dr JS Sarma in New Delhi, a delegation of the Cell, led by its national convener Shri Sanjay Bhalla, demanded direct compensation to the telecom consumers who suffer from unsolicited telemarketing SMS or phone calls.

The memorandum demanded the implementation of a system that makes it mandatory for telecom service providers and telemarketers to pay telecom users for unsolicited text SMSs and automated voice calls. The delegation demanded the TRAI to issue a notification directing the Access Providers to directly credit to the accounts of telecom users, Rs five for every unsolicited commercial communication SMS and Rs 10 for every unsolicited commercial communication voice mail.

Shri Bhalla claimed that the system is technically feasible. "We have discussed this issue with several telecom providers and they do not see much difficulty in implementing this system," he said. He pointed out that the TRAI chairman principally agreed to their demand and assured them to study it.

C.O.S. Sri T.Sundararajan retired from service

DSC_1855Our Circle Organising Secretary, Sri T.Sundararajan, serving at Akkur telephone exchange in Kumbakonam SSA retired from service on 31-1-2011. A grand farewell function was held at Mayiladuthurai on 10th February 2011. Sri T. Sundararajan was a dedicated FNTO member and held several Divisional and Circle level posts in the past and used to work hard for settling the grievances of members. And in recent times, when some vested elements left our union just at the time of 5th membership verification, his role to keep majority of our members with us is to be remembered with gratitude.DSC_1938 Sri Lingamurthy, JGS/CHQ and Circle Secretary, Chennai Telephones participated and greeted him on behalf of CHQ as well as Chennai Circle union. Sri D. Chandrasekaran, Circle secretary, Tamilnadu elaborated his service to the department and to the union and wished him a peaceful retired life. Sri Rajarethinam, DS/KMB had organised the function in a grand manner. Several other District and circle office bearers also participated.
We also wish him a peaceful retired life but request him to be active in trade union organisational activities , as he was always used to.

Pre-2006 pensioners pension revision --- latest

11.02.2011: The orders for pension revision are under submission to Finance Wing in DOT i.e DDG(FEB). The file has been cleared by SO(FEB) and it has been sent to ADG(FEB) today. ADG(FEB) is likely to take another 2 days and he may clear the file by 15.02.2011.

Its backward journey to Member(S) may take another 2 days. Further release of orders and Hindi translation etc. may take another week or so.

After all the orders may be issued just before 28.02.2011 which is the target date for DOT to issue the orders for pension revision.

BSNL losing battle due to Government policies

In the times of intense competition in the telecom selctor,  government  policies and decisions are jeopardising  the future of State owned Bharat Sanchar Nigam Ltd (BSNL). The case here is that of the allocation of non-standardised Broad- band Wireless Access (BWA) Spectrum to  the BSNL, while private operators have got more efficient radio waves  to  launch  their high.speed  broadband services.
   Moreover, despite getting  inferior spectrum, the BSNL was asked to pay amount similar  to what private companies paid after bidding.

Sometimes, we are appreciated also

NEW DELHI, INDIA: Bharat Sanchar Nigam Limited in its 10 year as a corporation was lauded by ministers and senior officials for meeting its social responsibility but at the same time all these top government figures acknowledged the need to improve the company’s balance sheet.

BSNL had reported loss of Rs 1823 crore approximately for financial year 2009-10.

“BSNL as corporation in 10 year of its operation has created key role in economic and social development of the country. It is BSNL on which the government depends at large to provide various telecom services to masses at large and particularly to the rural and under-served people of the country,” said R Chandrashekhar, Secretary, Department of Telecom, while speaking at BSNL Seva Padak Award 2010 ceremony on Tuesday evening.

Chandrashekhar expressed hope that BSNL would continue to discharge its obligation towards the people of this country while keeping an eye on its bottom line.

“It is difficult to achieve but at the same time it is something which has to be done. The fact that BSNL's overall performance in terms of market share, revenue and profitability has slidden is a matter of concern. BSNL's market share has come down to 14.5 per cent. The organization has some of the best talent in telecom technologies but innovation, marketing and customer interface are some area on which the company needs to work more,” said Chandrashekhar.

The Telecom Secretary mentioned that the company needs to think and act like any other competitive organization.

“Being a public sector enterprise, BSNL has special challenges. It may not be able to posses all the freedom that is available with private telecom companies to improve profitability but at the same time it has the opportunity to find its own way for sustaining in competitive environment,” said Chandrashekhar.

Chandrashekhar pointed out that BSNL should take inspiration from other PSUs that in spite of similar constraints, which BSNL faces, are doing very well. The Telecom Secretary thinks advent of 3G services and MNP roll out in the coming days are going to increase challenges for the company but it should see these challenges as opportunity and make difference in the market.

He appreciated the improvement of BSNL market share in broadband segment.

“BSNL has improved its market share which now stands at 61 per cent. This needs to be sustained and expanded. Enough opportunity exists in the broadband segment as market penetration is very low,” said Chandrashekhar.

Sachin Pilot, Minister of State for Communications and Information Technology lauded the services being rendered by BSNL and its employees throughout the country.

“BSNL stands accountable to the government, to Parliament and through Parliament to the people of this country. I have seen that at the time of need in any part of the country BSNL employees stand to fulfill government's obligation as their own responsibility. BSNL employees have stood with their responsibility even in the tough climatic condition of Leh,” said Pilot.

Pilot mentioned that close to three lakh people work in BSNL and the telecom provider can efficiently use their talents to become as competitive as any telecom company in the country.

I don’t see reason to believe that BSNL lacks in technology, talent, capability, energy that other telecom companies have. When I meet BSNL employees in any part of the country then I think that we can bring back the old days of BSNL. Today there are less than 1 per cent people in the country that have broadband connection. It shows a big opportunity for BSNL,” said Pilot.

Making public appearance after a long time, Gurudas Kamat, Minister of State for Communications and IT did not miss the opportunity to take a ride on controversies that exist in the country. In his brief remark, he stressed that all companies should bring in more transparency in their working.

“Telecom sector has contributed to the nation’s economic growth. All the companies in the sector need to be transparent, and not buckle down under any pressure, in order to maintain the fair name of the organization and the nation,” said Kamat.

Union Minister for communications and IT, A Raja specially asked media to observe BSNL’s challenges and also his initiatives to encourage the telecom PSU.

Some people accuse that BSNL’s profitability is coming down. Friends from media and other domain should know that the duties that have been bestowed upon BSNL is not exclusively based on commercial purpose but it is the only organization that is giving social obligatory function to the common people. When there was hue and cry in Leh, none of the operators thought of giving service to people there. It was only BSNL that was asked to provide service to people there,” said Raja.

Raja said his decision to give 3G spectrum to BSNL on priority basis was an encouragement to the company.

“When the decision was taken to auction the spectrum, we took a policy decision that one slot will be given to BSNL in each circle and it will have to match the winning price,” said Raja.

Raja promised to extend all possible support from his ministry to make BSNL a profitable company.

The BSNL event was a rare occasion which saw the presence of all the three ministers from the ministry.

Gopal Das, chairman and managing director, highlighted efforts being made by the PSU to improve its services.

“We are quickly enhancing customer service by implementing superior billing and ERP system. We have launched massive training program for BSNL employees so that they can redefine themselves as skillful and trained workforce,” said Das.
